I have requested James Marshall Military Records Date Requested: November 23, 2008. Update: I received a letter from Military Archives on December 4th these military records were destroyed in a fire in 1974. With additional information they can attempt to reconstruct information. I sent them his war record and registration information.
Question: Did J.M. fight in WW 1 According to the 1930 census it said he was a veteran of WW. However preliminary research shows that those serving in Regiment 5 did not fight in the war. Maybe he served during the period, but never fought.
Question: Why did he only serve for 1.5 years?
Question: If J.M. did participate in the fighting, what battles did he fight in? Any medals?

The following Obituary was released from Radcliff Funeral Home, Mr. Marshall Neal, age 91 of 3308 West Highway 22 (Centerfield) Crestwood passed away Monday morning, July 22, 1985 at the Baptist Hospital, East, Louisville. Mr. Neal was a Oldham County Native the son of the late James Newton and Mattie Belle Doak Neal. He was a member of the Mt. Tabor Methodist Church. An Army veteran of World War I. Mr Neal was a retired auto mechanic having been employed by the former Riebel Chevrolet and Ellis Motor Company and Smiser and Carter. He is survived by his wife the former Libby Bush, a daughter - Mrs. Rocky (Carol) Black, Crestwood; 2 sons, Mr. Marshall L. Neal of Fort Lauderdale, FL and Mr. J. W. Neal, Campbellsburg, KY; 7 Grandchildren and 1 great grandchildren; Funeral Services were conducted at 2:00 pm Thursday, July 25th at theRadcliffe Funeral Home, LaGrange by the Rev Richard Hollioway, pastor of the Mt. Tabor UMC. Interment was in the Mt. Tabor Cemetery.

His Tuesday, July 23, 1985, Courier-Journal obituary read: "Marshall NEAL, 91, of Crestwood, died Monday at Baptist Hospital East. He was a native of Oldham County, a retired auto mechanic, an Army veteran of World War I and a member of Mount Tab United Methodist Church. Survivors include his wife, the former Libby BUSH; a daughter, Mrs. Carol BLACK of Crestwood; two sons, Marshall L. NEAL of Fort Lauderdale, Fla., and J. W. NEAL of Campbellsburg; several grandchildren; and a great-grandchild. The funeral will be at 2 p.m. Thursday at Radcliffe Funeral Home in La Grange, with burial in Mount Tabor Cemetery. Visitation at the funeral home will be after 3 p.m. Tuesday."
Henry County Local---July 25, 1985, it said "Marshall Neal, 91, of Crestwood, died Monday, July 22, 1985, at the Baptist East Hospital, Louisville. He was a native of Oldham County, a member of the Mount Tabor United Methodist Church, an army Veteran of WWI and a retired auto mechanic. He is survived by his wife: Mrs. Libby Bush Neal, Crestwood; one daughter: Mrs. Rocky (Carol) Black, Crestwood; two sons: Marshall L. Neal, Ft. Lauderdale, FL and J. W. Neal, Campbellsburg; seven grandchildren and one great-grandchild. Funeral services were held at 2 p.m. Thursday, July 25th at the Radcliffe Funeral Home, LaGrange. Rev. Richard Holloway, pastor of Mount Tabor Church, officiated. Interment was in the Mount Tabor Cemetery.
On his headstone it read "James Marshall NEAL (May 4, 1894 to July 22, 1985".

- On April 3, 1934, James Marshall and Thelma Neal were sued by their mortgage company. The court documents filed in Jefferson County, Kentucky had, "Number: 235920, Plaintiff: Metropolitan Life Insurance Company vs Defendants: James Marshall Neal and Thelma Neal. Plaintiff states that the defendants James Marshall and Thelma Neal, executed and delivered to the Southern Trust Company of Louisville, Kentucky, one principal provisional note dated September 6, 1927, whereby they, and each of them, promised to pay to the Southern Trust Company, or order, the principal sum of Three Thousand and no/100 Dollars, ($3000) with interest thereon at the rate pf six per cent per annum, payable semi-annually on the first day of February and August in each year, and the principal to be paid in semi-annual installments of Ninety and no/100 Dollars ($90.00) each on the first day of February and August of each year, beginning August 1, 1928, and the remainder due and payable on the first day of February, 1943. Said note is filed herewith and made in part hereof, marked exhibit "A."
Plaintiff states that simultaneous with the execution of said note and to secure payment, said defendants, Marshall Neal and Thelma Neal, executed, acknowledged and delivered to said Southern Trust Company a mortgage whereby they placed in lien a certain lot of parcel of land situate, lying and being in the City of Louisville, County of Jefferson, State of Kentucky, described as follows: A certain lot or parcel of land situate, lying and being in the City of Louisville, County of Jefferson, State of Kentucky, as follows. Being the east 50 feet of lot No. 27 as shown on the Plat of the Subdivision known as Belcourt, which plat is recorded in Plat and Subdivision Book 1, pages 220 and 221 in the office of the county Court Clerk of Jefferson County, Kentucky. Being part of the same property a part of which was conveyed to Marshall Neal and Thelma Neal, his wife, by deed recorded in Deed Book 1119, page 322 and the remainder was conveyed to Thelma Neal, wife of Marshall Neal, by deed recorded in Deed Book 1125, page 97 all in the Clerk's office aforesaid.
Together with all the hereditements and appurtenances thereunto belonging or in any wise appertaining, including storm and screen windows and doors; gas, step(sic), electrical or other heating and lighting apparatus and all other fixtures appurtenant to the said premises. Said mortgage was thereafter lodged for record in the office of the County Court Clerk of Jefferson County, Kentucky of the 13 day of September 1927 and is recorded in book 1300, page 13 in said Clerk's office. It states that by reason of said assignment it became, and is now the ownder of said note and mortgage, and acquired and not holds a first and superior lien against the real estate hereinabove described, and against the rents, issues and profits therefrom to secure payment of note
Plaintiff states that said note is subject to the following credits:
Which paid the interest on said loan up to the first day of Feb, 1932, and paid on the principal sum of said loan Six Hundred Thirty and no/100 Dollars ($630). But that the principal installment due February 1, 1932 was not paid. Plaintiff states that balance due on said note and mortgage, according to the terms and conditions thereof, on the first day of August, 1932, the sum of Ninety and no/100 Dollars ($90) due on the principal, and the sum of Seventy-one and 10/100 Dollars ($71.10) due as interest making a total of One Hundred Sixty-one and 10/100 Dollars ($161.10). Plaintiff states that the defendants, Marshall Neal and Thelma Neal, and each of them, have breached and violated the termsoftheir contract and agreement, in that they failed and refused to pay the said principal installment which became due on said note and mortgage on the first day of August 1932. Plaintiff further states that said note contains, among others the following provision, "Upon failure to pay any installment of principal, or any installment of interest on this not when due, then the remaining installments of principal, secured by said mortgage, shall at the option of the holder, at once become due and payable." Plaintiff further states that if exercised the option contained in said principal note to declare and it did declare, and does now declare, the indebtedness described in said note due and payable as of 1st day of August, 1932, and that by the exercise of said option, there became due and payable on said note, the sum of Two thousand Four Hundred and Forty-one and 10/100 Dollars ($2441.10) together with interest thereon at six per cent per annual, payable semi-annually from the first day of August, 1932, subject to the following credits
No part of which has been paid, and all of which is now due and owing this plaintiff and that to secure the payment of sums, this plaintiff acquired and now has a lien against the property herein described prior and superior to all other liens, except the lien for unpaid taxes. Plaintiff further states that by the terms and provisions of said mortgage filed herewith as exhibit "B" the defendants Marshall Neal and Thelma Neal contracted and agreed to pay all taxes, charges and assessments lawfully levied against said property, and any of same not paid when due, may be omit by the party of the second part, its successors or assigns and all sims so paid shall bear interst at the rate of six percent for annum, payable semi-annually, from date of payment, and shall become a part of the mortgage devy. Plaintiff further sttes that the defendant a Marshall Neal and Thelma Neal failed and refused to pay taxes assessed against the property hereinabove described as follows:
Are omitted said taxes to become delinquent and has since failed and refused to pay the same or any part thereof. Plaintiff further states that in the exercise of the authority conferred by the aforesaid provision of said mortgage and pursuant to the right conferred by Kentucky Statues and in order to protect its lien against said property, it, on the 6th day of March 1934 paid said taxes, penalties, interest and costs, amounting to the sum of

.. dollars ($230.35). It states that is has demanded payment of said sum of the defendants and that they have not since paid said sum, or any part thereof, and pursuant to the
provision of said mortgage and of the statues of this state, this plaintiff is entitled to recover said amount from the said defendant with interest thereon at the rate of six percent per annum, payable semi-annually, from the 6 day of March 1934 until paid, and to secure the payment of said sum this plaintiff has a prior lien against the property hereinabove described. Plaintiff further states that by the terms and provisions of said mortgage to the Southern Trust Company the defendants Marshall Neal and Thelma Neal contracted and agreed to keep the buildings on said promises insured against loss or damage by fire or windstorm and to pay the premiums on said insurance policies when due, with mortgage loss clause payable to the mortgages, its successors, or assigns, and to forthwirth deposit all such policies with the mortgages, its successors, or assigns. That upon failure to keep said property so insured, or to furnish said policies, or to pay the premiums thereon, said premiums may be paid my mortgages, its successors, or assigns, and all sums so paid shall bear interest at the rate of six percent per annum payable semi-annually from the date of payment and shall become a part of the mortgage debt. It states that said defendant breached and violated the terms of their contact in that they failed to so keep said property insured and that on the 2 day of January 1934 plaintiff in the exercise of the option contained in said mortgage affected said insurance upon the improvements on said property, paid the premium has been paid to plaintiff, and that there is now due and owing to plaintiff the additional sum of

Plaintiff states that there are no other liens against said property known to it. Plaintiff further states that by the terms of the mortgage filed herewith as exhibit "B" it was contracted and agreed that upon the institution of proceedings to foreclosure said mortgage, plaintiff should be entitled to have a receiver appointed by the court to take care of the premises and collect the rents and profits and to keep the buildings in good repair. It states that this is an action to foreclosure said mortgage that its conditions have been breached and violated and that the mortgaged property is probably insufficient to pay the mortgage debt. It states that it does not have adequate means, or any means, to collect the rents, issues, and profits, without the appointment of a receiver by the court to take possession of the property and collect the rents, issues and profits and to hold the same subject to the further orders of the court. Divorce Record of Thelma Neal and James Marshall Neal; In a Judgment for Divorce dates 3/26/1934, it said "Plaintiff, Thelma Kaufman Neal vs. Defendant, James Marshall Neal. Plaintiff, Thelma Neal, states she and defendant intermarried and became wife and husband in Louisville, Kentucky of or about June 16th, 1920; that they have been since said time, and are now wife and husband. Plaintiff states she and defendant have been actual residents of Kentucky continuously for more than one year before the filing if this action, and usually reside in Jefferson County. Plaintiff states that, without like or fault on herpart, the defendant herein has habitually behaved towards her for not less than six months in each cruel and inhuman manner as to indicate a settled aversion toward her, or such as to destroy permanently her peace and happiness. Plaintiff states she has not been divorced before. WHEREFORE, plaintiff, Thelma Kaufman Neal, prays for a judgment of absolute divorce from the bonds of matrimony with defendant, for her costs, including an attorney's fee, and for all proper relief to which one say appear entitled. Kaufman, Buechel, Kentucky, which with answers thereto are to be head as evidence on behalf of plaintiff on the hearing of the above styled action.
In the Jefferson Circuit Court, Chancery Branch Division, it had "Agreed Order, Plaintiff, Thelma Kaufman Neal vs defendant, James Marshall Neal. The defendant, James Marshall Neal, enters his appearance herein, and waives setting at rules, notice of filing interrogatories, notice of taking depositions and submission, and agrees that interrogatories may befiled and proof taken immediately, and that upon the filing of the recommendations of the Commissioner herein this case may be, and is hereby submitted in chief. Signed by defendant, James Marshall Neal. Subscribed and sworn to before me by James Marshall Neal this 5th day of January, 1934. My commission expires December 10th, 1935. In the Depositions for Plaintiff, it had "Deposition of Blanche Kaufman taken on January 12, 1934 at 235 S Fifth Street, Louisville, Kentucky, to be read as evidence in behalf of plaintiff on the hearing of the above styled action, neither party, agent nor attorney being present at the examination of said witness; said witness being duly sworn, deposed as follows: 1) Blanche Kaufman. I have known the plaintiff all her life, of have known the defendant about fifteen years. They married in Louisville, Kentucky June 16th, 1920. 2) Plaintiff has lived in Kentucky all her life, and the defendant has lived in Kentucky during the 15 years I have known him. They usually reside in Jefferson County. 3) Her cause of action occurred in Kentucky, within five years next before this suit was filed. 4) He was very indifferent, and preferred to be with other people than with his own wife, occasionally he went out with the plaintiff but then he embarrassed her by ignoring her and being very indifferent in the presence of others. He criticized almost everything she did, and found fault with everything she did or suggested doing. If she had friends visit her he would walk out and leave, and did not seem to care whether it humiliated her or not. We lived in the same apartment building, and I know he stayed out late at night leaving her home along, he left her alone too much of the time. His conduct plainly indicated an aversion to her which destroyed per peace and happiness. He treated her in this manner for several years. She always treated him the best she could, tried to help him in every way she could and did not want to break up her home and lived with him as long as she could possible do so. She was not to blame for the treatment of her in many ways. According to the interrogatories by Clerk, 1) 60 years of age, 336 Kenilworth Road, Louisville, Kentucky, Housekeeper; 2) My statements are made from personal knowledge; 3) I have no interest in this case; 4) This is all I have to state. Interrogatories By County Attorney; 1) When this suit was filed they loved in Kentucky, and plaintiff has been a resident of Kentucky all her life; 2) My statements are made from personal knowledge; 3) They have not been married or divorced before; Signed by Blanch Kaufman. Also the depositions of M. F. Kaufman taken at the same time and place and action and behalf, neither party, agent nor attorney being part(?) of examination. Witness being duly sword according to law, in answer to the interrogatories hereto attached, deposed and says: 1) M.F. Kaufman, I have known plaintiff all my life, and have known defendant about fifteen years. They were married in Louisville, Kentucky on June 16th, 1920. 2) Plaintiff has lived in Kentucky all her life, and defendant has lived in Kentucky during the fifteen years I have known him. They usually reside in Jefferson County, KY. 3) Plaintiff's cause of action occurred in Kentucky and within five years next before the filing of this action. 4) For the past year he has gone out nights, he refused to take her with him and refused to do anything with her, nothing she did pleased him, and he found fault with everything. If she had any friends visit her he would leave and caused her much humiliation before her friends by acting this way. He did not have any consideration for her at all and continually embarrassed her by ignoring her in the presence of others. His conduct plainly indicated he has an aversion toward her which permanently destroyed her peace and happiness. I have heard him say he did not care anything about her and caused her much unhappiness by criticizing her and leaving her at nights and ignoring her. Sometimes he did not get home until two or three o'clock in the morning and always spent his Sunday's from her. He has treated her in this way for at least a year, without any fault on her part. She was a good wife to him, always has his meals and cloths ready, and tried to make a good home for him. She gave him no reason for acting as he did, and was not to blame for his treatment of her. Interrogatories by Clerk. 1) 30 years of age, Route 2, Buechel, KY Contractor, 2) My statements are made from personal knowledge, 3) This is all I have to state. Interrogatories by County Attorney. 1) When this suit was filed both parties lived in Louisville, KY They have lived in Kentuck ever since I have known them, 2) My statements are made from personal knowledge, 3) Neither of them have been divorced before. In the Report of Commissioner, "Plaintiff: Thelma Neal, Defendant, James Marshall Neal. Your Commissioner finds and recommends: 1) Petition filed January 5, 1934. Order of appearance and waver filed January 8, 1934. Evidence by interrogatories filed January 13, 1934. 2) Petition states a cause of action; 3) The Court has jurisdiction of the case; 4) Residence and marriage are established by competent testimony; 5) The essential allegations of the petition are proven; 6) recommends plaintiff be granted an absolute divorce from the bonds of matrimony with defendant, James Marshall Neal, and that she recover her costs herein expended, including a fee of $50.00 for her attorney. Filed March 17, 1934 and signed by Charles T Ray Commissioner.
